Shari’a coming to Kenya, courtesy of the USA?

This is going to be a controversial article. I already admit this. However, this story must be exposed. I have contacted several influential organizations in an attempt to get some traction in the media on this issue and my efforts have been for naught thus far. I gave ACT! for America first shot. I heard nothing. I then sent information to Congresswoman Sue Myrick’s office. Again, nothing. I sent the story to WorldNetDaily and was met with silence. It looks as if I am on my own. After August 4, I will be able to respond to these groups and say, “I tried to warn you, but you would not listen.”

This will be long by necessity. This is serious. I will expose the changes coming to Kenya on August 4 should their new constitution pass, and according to all reports, it will pass. I will then demonstrate that the Obama administration played an illegal and significant role in pushing for the new constitution.

1. Shari’a Coming to Kenya

To understand the following, you will need to have two documents in hand: A copy of the The current Constitution of Kenya and a copy of the proposed draft constitution.

For the first time in the history of Kenya, should the proposed constitution pass, abortion will become legal for all citizens of Kenya. This is the focus of all the media attention in Kenya. But there is an even more sinister aspect to this new constitution that only one media outlet has touched on thus far: It will bring Shari’a law to Kenya and eliminate freedom of religion. Don’t believe me? Read on.

Kadhis Courts (Shari’a law)


Kadhis courts (sharia) have been a part of the Kenyan legal system since prior to Kenya’s independence from the UK. These courts were allowed to operate along a 10 mile coastal strip which was set up as a protectorate in an agreement with the Sultan of Zanzibar and the UK. This protectorate was to have certain freedom and autonomy apart from the rest of Kenya, which at the time was a British colony. Thus, when Kenya gained its independence, a provision for Kadhis courts to operate in the protectorate land was included in constitutional language. This language can be found in Kenya’s current constitution under article 66.

Section 66(4) of the current constitution reads:

(4) The Chief Kadhi and the other Kadhis, or the Chief Kadhi and such of the other Kadhis (not being less than three in number) as may be prescribed by or under an Act of Parliament, shall each be empowered to hold a Kadhi’s court having jurisdiction within the former Protectorate or within such part of the former Protectorate as may be so prescribed:

Provided that no part of the former Protectorate shall be outside the jurisdiction of some Kadhi’s court.

New constitution

The proposed constitution removes language that restricts Kadhis courts to the former protectorate land and adds provisions allowing for Kadhis courts to be established throughout Kenya, at taxpayer expense, to serve the Muslim community. The specifics are found in the draft, sections 169 and 170, reprinted below for reference.

169. (1) The subordinate courts are—

(a) the Magistrates courts;

(b) the Kadhis’ courts;

(c) the Courts Martial; and

(d) any other court or local tribunal as may be established by an Act of Parliament, other than the courts established as required by Article 162(2).

(2) Parliament shall enact legislation conferring jurisdiction, functions and powers on the courts established under clause (1).

Kadhis’ Courts

170. (1) There shall be a Chief Kadhi and such number, being not fewer than three, of other Kadhis as may be prescribed under an Act of Parliament.

(2) A person shall not be qualified to be appointed to hold or act in the office of Kadhi unless the person—

(a) professes the Muslim religion; and

(b) possesses such knowledge of the Muslim law applicable to any sects of Muslims as qualifies the person, in the opinion of the Judicial Service Commission, to hold a Kadhi’s court.

(3) Parliament shall establish Kadhis’ courts, each of which shall have the jurisdiction and powers conferred on it by legislation, subject to clause (5).

(4) The Chief Kadhi and the other Kadhis, or the Chief Kadhi and such of the other Kadhis (not being fewer than three in number) as may be prescribed under an Act of Parliament, shall each be empowered to hold a Kadhi’s court having jurisdiction within Kenya.

(5) The jurisdiction of a Kadhis’ court shall be limited to the determination of questions of Muslim law relating to personal status, marriage, divorce or inheritance in proceedings in which all the parties profess the Muslim religion and submit to the jurisdiction of the Kadhi’s courts.

The implementation of courts of Shari’a law nation-wide, at taxpayer expense, to serve Muslims exclusively, bothers me and it should bother you.

Muslims exempt from bill of rights

Under the current constitution, all citizens are entitled to the provisions included in the bill of rights, found in articles 70 through 86 of the current constitution.

The proposed constitution declares the bill of rights under articles 19 through 51. But the draft contains an interesting provision in article 24. This exemption is not found in the current constitution.

(4) The provisions of this Chapter on equality shall be qualified to the extent strictly necessary for the application of Muslim law before the Kadhis’ courts, to persons who profess the Muslim religion, in matters relating to personal status, marriage, divorce and inheritance.

In other words, certain freedoms guaranteed to other Kenyans as fundamental rights will necessarily be limited for Kenyan Muslims so that Shari’a law can be enforced properly. What rights might these be?

The Right to Change One’s Religion

Article 78 of the current constitution is entitled “Protection of freedom of conscience” and describes certain freedoms guaranteed all citizens:

78. (1) Except with his own consent, no person shall be hindered in the enjoyment of his freedom of conscience, and for the purposes of this section that freedom includes freedom of thought and of religion, freedom to change his religion or belief, and freedom, either alone or in community with others, and both in public and in private, to manifest and propagate his religion or belief in worship, teaching, practice and observance. (emphasis mine)

The new constitution contains similar wording in Article 32. I have reprinted Article 32 here in whole to make a point:

Freedom of conscience, religion, belief and opinion

32. (1) Every person has the right to freedom of conscience, religion, thought, belief and opinion.

(2) Every person has the right, either individually or in community with others, in public or in private, to manifest any religion or belief through worship, practice, teaching or observance, including observance of a day of worship.

(3) A person may not be denied access to any institution, employment or facility, or the enjoyment of any right, because of the person’s belief or religion.

(4) A person shall not be compelled to act, or engage in any act, that is contrary to the person’s belief or religion.

Did you notice language of the current constitution that was eliminated from the new draft?  …freedom of thought and of religion, freedom to change his religion or belief … this language has disappeared from the new constitution. In other words, should the new constitution pass, no Kenyan will possess the right to change his religion or belief. It has been removed from the bill of rights.

The Right to Propagate One’s Faith and Religion

Again we look to article 78, this time focusing on other specific language.

78. (1) Except with his own consent, no person shall be hindered in the enjoyment of his freedom of conscience, and for the purposes of this section that freedom includes freedom of thought and of religion, freedom to change his religion or belief, and freedom, either alone or in community with others, and both in public and in private, to manifest and propagate his religion or belief in worship, teaching, practice and observance. (emphasis mine)

Again looking at Article 32 of the proposed constitution, we once again find a glaring ommission.

32. (1) Every person has the right to freedom of conscience, religion, thought, belief and opinion.

(2) Every person has the right, either individually or in community with others, in public or in private, to manifest any religion or belief through worship, practice, teaching or observance, including observance of a day of worship.

The phrase in the current constitution “… to manifest and propagate his religion or belief in worship” no longer appears in the new constitution. The existing language allows the freedom to propagate one’s religious beliefs, but if the new draft constitution is passed this will no longer apply. This specific language has been removed.

The Right to Establish Religious Schools

Article 78 of the current constitution, section (2) reads:

(2) Every religious community shall be entitled, at its own expense, to establish and maintain places of education and to manage a place of education which it wholly maintains; and no such community shall be prevented from providing religious instruction for persons of that community in the course of any education provided at a place of education which it wholly maintains or in the course of any education which it otherwise provides.

The draft constitution has removed this language altogether. Thus, no Kenyan citizen will have the right to open a religious school for the purposes of religious education and to propagate the faith of the individual.

All Religions to be Treated Equally

Preliminary drafts of the constitution contained language that all religions be treated equally (see article 10 of the Nov. 2009 draft). Such language has been removed from the final draft, which now says simply:

8. There shall be no State religion.

Apparently the draft committee recognized that the new constitution favors Islam above all other religions and struck the language that guaranteed all religions be treated equally.

2. America is complicit in pushing the new constitution

While in Kenya in late May, I learned that the Obama administration pumped the equivalent of $10 million into the YES campaign to pass the proposed constitution. The Daily Nation, a major newspaper in Kenya, ran an article about this. The media in the US are focusing on the abortion aspect of this illegal donation. Yet when the money was given, no mention was made as to why the US is funding an internal political issue in Kenya. Could it be that the abortion issue is merely a smokescreen used to deflect attention from the deeper and more troubling issues of sharia’ law and loss of religious freedom as I have outlined above?

Shortly after the illegal donation of US money, Vice President Biden paid a visit to Nairobi, where he promised Kenyans that if they pass the new constitution, they can expect to receive more foreign aid from the US.

The personal involvement of both President Obama and Vice President Biden in the internal affairs of Kenya begs a few questions:

1. Why does our administration have a vested interest in seeing a pro-Islamic constitution adopted in Kenya?

2. What right does Obama/Biden have interfering in the internal politics of this independent nation which is one of the last bastions of vibrant Christianity on the African continent?

3. Why is our media not covering this story with adequate interest and investigative reporting, since our President and Vice President are both involved?

3. Prime Minister Odinga: Islamic sympathizer?

I received via email today a document that purports to  show there was a conspiracy to manipulate the voter count for Presidential election in Kenya which took place in 2007. The outcome of this election sparked widespread rioting throughout Kenya.

Raila Amollo Odinga is currently serving as Prime Minister of Kenya. An internet search for Odinga and Obama will return a plethora of articles showing the family relationship between these two. According to an article at Wikipedia, Odinga was born into an Anglican household and was later baptized as an evangelical Christian. Nevertheless, he is reported to have signed a memorandum of understanding with radical Muslims to garner their votes. The website WorldNetDaily ran an expose of the MOU in 2008, which demonstrated links between President Obama and Odinga. If the government of Kenya contains leaders who are sympathetic toward Islam, it would not be surprising to find a constitution written as the proposed draft has been. Since WND broke the story, the Memorandum appears to be valid. Again, our President, who was a Senator at that time, was involved in installing a pro-Islamic high ranking government leader in Kenya, a nation which now seems willing to pass a pro-Islamic constitution, once again backed by Obama.

Below in italic font is the wording of the document I received. It was signed by (1) Abdullah Abdi, Chairman of the National Muslim Leaders Forum, (2) Raila Amollo Odinga, and (3) Najib Balala, a Muslim Member of Parliament.

Both Abdullah Abdi and Odinga are mentioned in this article, which praises Odinga for his pro-Muslim agenda.

You can download a copy of the MOU_between_Ralia_Odinga_and_Muslims for your personal reference. Again, the Assyrian International News Agency ran an article on this MOU, but the link to the document is no longer active.

Also NOTE: A search in the internet for this MOU will reveal articles that acknowledge an MOU was indeed signed by those purported to have entered into the agreement. But there may be two MOUs circulating on the internet; the original and a forgery. I make no claim to knowledge which MOU is the original, although based on reports from other reputable news websites, there is a very high probability this MOU is authentic and original. Nevertheless, the existence or absence of such an MOU is moot regarding the changes to the constitution outlined above. These are real and can be verified. The MOU, if it is genuine, simply sheds another interesting angle on this entire issue of the Islamization of Kenya.

PURPOSE: To establish a lasting relationship between Hon. Raila Amolo Odinga, hereinafter referred to as The Candidate, and the National Muslim Leaders, hereinafter referred to as The Leaders.

This MOU states as follows:

WHEREAS The Candidate – who recognizes Islam as the only true religion – is seeking to become the next President of the Republic of Kenya;

WHEREAS The Leaders recognize The Candidate as the only presidential candidate who has the interests of the Kenyan Muslim community at heart;

WHEREAS The Candidate has pledged to fully reinstate and protect the rights of the Kenyan Muslims community at heart;

WHEREAS The Leaders represent a peaceful and God-fearing Kenyan community that has been oppressed and discriminated gainst by the current and previous governments, and

WHEREAS The Candidate freely acknowledges that, indeed, the current and previous governments have failed to recognize and protect the rights of the Kenyan Muslim community;

The Parties agree as follows:

(i) That The Leaders forthwith endorse The Candidate as the official 2007 Presidential candidate of the Kenyan Muslim Community.

(ii) That The Leaders will campaign vigorously for The Candidate to ensure his resounding victory in the 2007  Presidential election.

(iii) That The Leaders will work hard to ensure that all (or at least the majority) of Kenyan Muslim faithful will vote overwhelmingly for The Candidate in the 2007 General Election.

(iv) That The Leaders will deploy all resources at their disposal to support The Candidate’s campaign throughout the country.

(v) That The Candidate when, InshaAllah, he becomes President of Kenya will:

a) Ensure that the Coast Province shall henceforth be known as JIMBO LA PWANI and shall have full autonomy in Governance in all matters apart from National Defence and International Accreditation. In addition, while freedom of worship will be upheld at the JIMBO LA PWANI, the Council of Islamic leaders shall be permitted to have an oversight role to monitor activities of ALL other religions and any applications for religious activities and institutions will require their approval. They shall have the right to deny approval to cults and other evil practices.

b) Within 6 months rewrite the Constitution of Kenya to recognize Shari’a as the only true law sanctioned by the Holy Qur’an for Muslim declared regions.

c) With immediate effect dismiss the Commissioner of Police who has allowed himself to be used by heathens and Zionists to oppress the Kenyan Muslim community.

d) Disband the imperialist Anti-Terror Police Unit (ATPU) that was set up for the sole purpose of terrorizing, harassing, intimidating and deporting innocent Kenyan Muslims to Guantanamo Bay.

e) Ensure THAT ALL MUSLIMS residing within the Republic of Kenya, and especially those who reside in the North Eastern Province, shall be granted full National Identity Cards, and thereafter, North Eastern Province shall also be granted majimbo status no less favorable and on similar terms with JIMBO LA PWANI within six months of Raila Amollo Odinga being sworn in as President.

f) No Muslim residing in Kenya whether a citizen, visitor or relative of any of the above shall be subjected to any process involving the laws of a foreign country and in particular any Muslim arrested for or suspected of Terrorism or any other International crime shall only be tied within the borders of Kenya and shall be granted a competent lawyer of his/her choice at the expense of the Government.

g) Within 1 year facilitate the establishment of a Shariah court in every Kenyan divisional headquarters.

h) Popularize Islam, the only true religion, in the Coast and North Eastern Regions by ordering every primary school in Kenya in the regions to conduct daily madrassa classes.

i) Impose a total ban on open-air gospel crusades by worshippers of the cross in the Coast and North Eastern regions.

j) Outlaw gospel programs (preaching, purported faith healing, etc) in KBC, the National Broadcaster.

k) Impose a total ban on the public consumption of alcoholic beverages in the Coast and North Eastern regions and their towns of Mombasa, Malindi, Lamu, Garissa, Wajir, Mandera, Kwale, Vanga, Lunga Lunga,and all other Muslim populated urban centres of Kenya whose population is at least 40% (forty percent) Muslim.

l) Quash the recent legalization of mnazi, busaa, muratina, kaluvu,and all other haram beverages.

m) Close down Farmer’s Choice in Jimbo La Pwani and Jimbo La Kaskazini Mashariki and other factories that process and package swine and other haram products in regions populated by Muslims including the Coast and North Eastern regions.

n) Impose an immediate ban on women’s public dressing styles that are considered immoral and offensive to the Muslim faith in the Muslim regions of the Coastal and North Eastern Regions. This ban will apply to Muslims and non-Muslims alike in these regions and will include all visitors whether domestic or foreign tourists.

vi) In consideration for the above and to enable and assist ODM and The Candidate win the National Elections and the Presidency of the Republic of Kenya, NAMLEF and its affiliate organizations hereby undertake to fully support the ODM as a party and Raila Amollo Odinga as a presidential candidate in all ways, and to mobilize Muslims for this cause.

vii) In furtherance of the above, and within a maximum of Seven (7) days hereof, NAMLEF and its affiliate organizations shall issue a joint statement declaring that all Muslims should support and vote for Raila Amollo Odinga and ODM.

viii) In addition, NAMLEF have impressed upon Najib Balala who is present herein that he should step down in favour of Raila Odinga in the Presidential nomination exercise within ODM, due to the fact that Raila Amolo Odinga has confirmed his support for all the aspirations of the JIMBO LA PWANI and the Kenyan Muslim community.

ix) THAT subsequently, NAMLEF and its affiliate organizations shall engage in active campaigns for Raila Amollo Odinga and the ODM throughout the Republic and impress upon Muslims, publicly and emphatically, the requirement to vote for ODM and Raila Amollo Odinga.

If this MOU is authentic, as it appears to be based on this story published recently by WorldNetDaily, it generates a question which deserves an answer. Are the changes to the constitution noted above, and to be voted upon August 4, a culmination of the promises made by Odinga in this MOU with the Muslim leaders of Kenya, albeit a few years later than hoped for? If so, the citizens of Kenya have a significant challenge to overcome in the next three weeks prior to the vote.


The new Constitution passed. Many laws of Kenya are now sharia compliant. The US media largely ignored this event. Here is the update I wrote: Kenya Gives Obama abortion, Islamic courts.

    Here are some Bible verses that Pres. Obama avoids:
    Proverbs 19:10 (NIV): “It is not fitting for a fool to live in luxury – how much worse for a slave to rule over princes!”
    Also Proverbs 30:22 (NIV) which says that the earth cannot bear up under “a servant who becomes king.”
    And Ecclesiastes 5:2-3 (KJV) advises: “let thy words be few…a fool’s voice is known by multitude of words.”
    Although Obama is not descended from slaves, he may feel that he’s destined to become a black-slavery avenger.
    Or maybe an enslaver of all free citizens!
    For the brain-dead, pro-murder politicians in Washington DeCeased who fix Social Security by voting to abort millions who otherwise could be paying into SS (!), I have two pro-life slogans I thought up:
    “Unborn babies should have the right to keep and bear arms – and legs and ears and eyes etc.!” and “Unborn babies should have the same right to be born alive that abortionists had!”

    Hi Joe thanks for the blog post. Please check out the ACLJ. I believe they are doing something in regards to this since they have offices in Africa. I can remember them taking some sort of action in Africa about the constitution of a part of Africa but cant remember off hand what part of Africa.     I need to add here a short comment. I don’t think the new constitution is all bad for Kenya. Indeed, there are many provisions that will have a positive impact on Kenya and which I would endorse were I a citizen. But as one pastor in Kenya quipped, Ecclesiastes 10:1 says, “Dead flies putrefy the perfumer’s ointment, and cause it to give off a foul odor.” Among the numerous good ideas in the proposed constitution are several “dead flies” and for this reason it must be rejected.

    Actually the whole world seems to be in love with Obama, more than the Americans themselves. Recent polls show that the Europeans would vote for him – if ofefred the opportunity – up to 70%, in some countries. It’s sickening and hilarious at the same time to see and hear odes for this nullity from the North Pole to the South Pole, on every newspaper, magazine, TV channel. Really, I’m almost frightened to open a publication these days: I’m sure I’ll find another article glorifying Messiah and how he will make the world a better place. Did he do something worth mentioning in his life? Did he ever say something memorable – except some blah-blah about “hope” and “change”? Then why all this noise about the Big Zero?Barack Obama is a man who lacks any substance, as a politician and as a person. He is entirely the product of the media and is created by the illusions of the Western leftist activists who, I guess, have been longing for a long time for their own Mao and Kim Ir-Sen. These Western activists had the ideology, but, to complete the picture, they missed the master, the Great Comrade, the One for whom their children should sing hymns about spreading happiness and freedom, “Obama’s gonna change it/and rearrange it”, etc. Now, they have it all: the ideology, the Beloved Leader, the songs. The picture is complete, their dream has come true. I guess if he is elected president, some people will joyfully march in public squares on his birthday, by their own will – unlike those in the Communist countries, who were forced to do so.

    It’s absolutely insnae that the United States can even contemplate electing a person such as Obama. You look like a defeated nation to the rest of the world if you elect an individual who has for an entire generation been a member of an organization dedicated to hating the founding, still-majority population of the country. Only a few years after the Jihadist attacks in 2001, Americans are about to elect a man with the middle name “Hussein” who has received education at an Islamic madrasa. Meanwhile, the Saudis are buying your universities and the Muslim Brotherhood is infiltrating your country.Maybe Multiculturalism and cultural Marxism will lead to the downfall of the last superpower, just like Communism led to the downfall of another superpower. You don’t necessarily need Islam to ruin a country; it just helps a lot.
